REFERRAL PROGRAM POLICY STATEMENT

1. Introduction

Encompassing Music LLC (hereafter "Company," "we," "us," or "our") is pleased to offer a referral program ("Program") to reward our existing users ("Referrers") for introducing new users ("Referees") to our SaaS services. By participating in the Program, you agree to the terms and conditions outlined in this policy.

2. Eligibility

• The Program is open to all existing users of Encompassing Music LLC who have an active subscription.
• New users must subscribe via the referral link or enter the referral code at the time of registration to be eligible for the one-time discount.

3. Referral Rewards

• Referees will receive a one-time discount on their initial subscription purchase when they subscribe using a referral link or enter a referral code.
• Referrers will receive subscription credits for each set number of paid new subscribers who use their referral code or referral link.

4. Code and Link Distribution

• Each existing user will be provided with a unique referral code and referral link.
• Referrers are responsible for accurate communication of their referral code and referral link.
• Referrers are encouraged to share their referral codes and links through various channels.
• Referrers are not, and will not represent themselves as, agents of or spokespeople for Encompassing Music LLC.

5. Responsibility for Sharing Referral Codes and Links

• Referrers are solely responsible for where and how they choose to share their referral codes and links.
• Encompassing Music LLC does not endorse any particular forum, platform, or method of sharing.
• Referrers should ensure that their sharing practices are legal and do not violate any regulations or policies of the platforms or forums they use.

6. Non-Exclusivity of Sharing Forums and Methods

• No forum, platform, or method of sharing is exclusive to any Referrer.
• Referrers may find other participants of the Program sharing their own referral codes and links in similar or the same forums, platforms, or methods.
• Encompassing Music LLC does not guarantee any Referrer exclusive rights to any particular method or platform for sharing their referral codes and links.

7. Company Advertising Efforts

• Encompassing Music LLC reserves the right to advertise and promote its services where and as desired.
• Such advertising efforts by the Company may attract new customers independently of any Referrer efforts.
• The presence of Company advertisements does not affect the tracking and rewarding of referrals made through the Program.

8. Usage of Logos and Trademarks

• Referrers may use Encompassing Music LLC logos and trademarks only in accordance with the laws and regulations of the jurisdictions in which we do business.
• "Encompassing Music MEASure®" is all one registered trademark and should be referred to in that way.
• Unauthorized or improper use of our logos and trademarks is strictly prohibited.

9. Claims and Representations

• Any claims made by Referrers about Encompassing Music LLC or its services are their own and do not represent the views or endorsements of the Company.
• Referrers must not make false or misleading statements about the Company, its services, or the Program.

10. Tracking and Accountability

• We will make reasonable efforts to properly receive, capture, and account for the use of referral codes. However, the success of the Program is largely dependent on the actions of new users.
• Encompassing Music LLC is not responsible for any failure to track or account for referral code uses due to errors, omissions, or actions by the Referees.

11. Disqualification and Termination

• Encompassing Music LLC reserves the right to disqualify any participant from the Program at its sole discretion, particularly in cases of suspected abuse, fraud, or violation of these terms.
• The Company reserves the right to modify or terminate the Program at any time without prior notice.

12. Limitation of Liability

• Encompassing Music LLC shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the Program.
• The Company's total liability for any claim arising out of or relating to the Program shall not exceed the value of the outstanding rewards earned by the Referrer.

13. Governing Law

• This policy and the Program shall be governed by and construed in accordance with the laws of the United States and the states of Delaware and Ohio.
